Terms of Service

1. Acceptance of Terms

By accessing or using vibbs.tv ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify users of material changes via the Platform or email.

2. Eligibility

You must be at least 18 years of age to use the Platform. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• Usernames must be unique. You may change your username once per account lifetime.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Artist Accounts

Artists who wish to create streams and receive payments must apply for an Artist Account. Artist accounts are subject to manual review and approval.

• Approval is at our sole discretion.
• Artists must provide truthful information in their application.
• Artist privileges may be revoked for violations of these Terms or our content policies.
• Artists are responsible for the content they stream and must ensure they have all necessary rights and licenses.

5. Content Standards

All content on the Platform must comply with the following standards. Content must be safe and advertiser-friendly. You may not stream, upload, or share content that:

• Contains sexually explicit or pornographic material
• Depicts or promotes violence, gore, or graphic content
• Contains hate speech, discrimination, or harassment based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic
• Promotes or facilitates dangerous or harmful activities
• Contains misinformation or deliberately misleading content
• Constitutes spam, fraud, or scam activity
• Involves illegal activity or promotes illegal conduct
• Infringes on intellectual property rights (copyright, trademark, etc.)
• Exploits or endangers minors in any way
• Contains malware, viruses, or harmful code
• Violates any applicable local, state, national, or international law

We reserve the right to remove content and suspend or terminate accounts that violate these standards without prior notice. Users may report content that violates these standards using the report functionality available on each stream.

5.1 Repeat Violations

We take repeat violations of these Terms and our Acceptable Use Policy seriously. Users who repeatedly violate our content standards or prohibited conduct face escalating consequences:

• First violations may result in content removal, a warning, or a temporary suspension, depending on severity.
• Repeat violators face stricter penalties, including longer suspensions, revocation of artist privileges, or permanent account termination.
• We consider your violation history when deciding appropriate sanctions. A pattern of violations, even if individually minor, may result in permanent ban.
• Creating new accounts to evade a ban or restriction is prohibited and may result in immediate termination of all associated accounts.

We reserve the right to take action, up to and including permanent termination, at any time for any violation, particularly for serious or repeated breaches.

6. Payments and Transactions

6.1 Ticket Purchases

• Users may purchase tickets to access paid streams.
• All payments are processed securely through Stripe. We do not store your payment card information.
• Prices are displayed in USD and include all applicable fees unless otherwise stated.
• Ticket purchases are final. Refunds are handled on a case-by-case basis at our discretion.

6.2 Tips

• Users may send tips to artists during streams.
• Tips are voluntary and non-refundable.
• A platform fee of 10% is deducted from tips.

6.3 Artist Payouts

• Artists receive payments through Stripe Connect.
• A platform fee of 20% is deducted from ticket sales (configurable).
• A platform fee of 10% is deducted from tips.
• The minimum payout threshold is $4.00 USD.
• Payouts are initiated manually by the artist and processed through Stripe.
• Payout timing depends on Stripe's processing schedule and the artist's bank.
• Artists are responsible for reporting income and paying applicable taxes.

6.4 Refunds and Chargebacks

• Refunds are handled on a case-by-case basis at our discretion.
• Chargebacks or disputed payments may result in suspension of payouts or access while we investigate.
• We may reverse or withhold payouts for transactions that are refunded, disputed, or fraudulent.

6.5 Live Digital Events

Paid live events are subject to our Live Events Policy, including cancellation, postponement, and technical-issue procedures.

7. Intellectual Property

7.1 Platform Content

The Platform, including its design, features, and content created by us, is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our Platform without our express written permission.

7.2 User Content

You retain ownership of content you create and stream on the Platform. By streaming content on vibbs.tv, you grant us a limited, non-exclusive, worldwide license to display, distribute, and promote your content in connection with the operation of the Platform.

7.3 Copyright Infringement

We respect intellectual property rights. To report copyright infringement, see our Copyright Policy and contact copyright@vibbs.tv. We respond to valid takedown requests in accordance with applicable law and maintain a repeat-infringer policy.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with or disrupt the Platform or its servers
• Use bots, scrapers, or automated tools to access the Platform
• Impersonate another person or entity
• Engage in fraudulent payment activities
• Circumvent any security measures or access controls
• Harass, bully, or threaten other users
• Create multiple accounts to evade bans or restrictions

8.1 Moderation and Appeals

We use a combination of automated signals and human review to enforce these Terms. You may report content directly on stream pages. If your content or account is removed or restricted, you can appeal by contacting support@vibbs.tv. We review appeals on a case-by-case basis.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Platform will be uninterrupted, error-free, or secure. During the beta period, you acknowledge an increased likelihood of bugs, downtime, and service interruptions.

We are not responsible for the content streamed by users or artists on the Platform.

Live streams and 3D virtual rooms may include flashing lights and motion effects. See our Health & Safety page. Use at your own risk if you have photosensitive or related health conditions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBBS.TV AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless vibbs.tv, its operators, affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Platform, your content, or your violation of these Terms.

12. Termination

• You may delete your account at any time by contacting us.
• We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.
• Upon termination, your right to use the Platform ceases immediately.
• Pending payouts for artists will be processed according to Stripe's policies, subject to any holds or reviews.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with applicable rules, except where prohibited by law. You agree to waive your right to participate in class action lawsuits or class-wide arbitration.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles, except where prohibited by law.

15. Third-Party Services

The Platform uses third-party services including but not limited to:

• Stripe - Payment processing (Stripe Terms)
• Supabase - Authentication and data storage
• Amazon Web Services (AWS) - Streaming infrastructure and hosting

Your use of these services is subject to their respective terms and privacy policies.
